I only have suspicions about her in August. Now I have actual proof of her deeds.

I have to wait until may 2012, 3 years of our marriage before I can file for divorce. Now she holds on to her iphone even when sleeping, instead of placing it for charging on the cupboard. and she deleted all her msgs when i checked it in the morning...

make sure you really have solid evidents...dun just rely on sms...you need photos...and dates of the adultery meetings...

You sound like in Singapore , is she a PR or pink ic already ?

Did you copy the telephone number she SMS ?

I am in singapore, she is on working permit. she took leave and went back to vietnam with our son for 18 days returned on 24 december. She used to return home from work and sleep around 12++. now its around 2am, watching drama and smsing him. i photo her sms and sent it to my phone. yesterday night she start to sleep with her phone...

Her "brother" is in vietnam. so i can only gather smses. can she claim custody of my babies while holding work permit? what else is she entitled to?

What else can i do? please advise. thanks

Just some general advice for you,

01) Under Singapore law all spouses have the right to claim custody of their kids regardless of their status (e.g. PR, citizen, work permit...ETC).

02) Even if you proved adultery, it only helps to substantiate and speed up the approval of the divorce process, and does nothing to mitigate the potential alimony claims from your ex-wife. You better hope she and her friends/relatives are totally country bumpkins that have no clear understanding of their rights under the Women's Charter.

03) Note all your cases will be heard separately, e.g. divorce process first, once cleared then you will proceed to alimony/maintenance/custody claims.

You better check with your legal adviser, I am very sure that you cannot backdate your 3 years period to the beginning of your marriage as you already have kids

1) sillypore law protects women blindly even if they are wrong
2) agree that adultery is just a reason for divorce. nothing else.
3) both divorce process and alinomy can be heard at same time if both parties agree.

did you go back vn with your wife or at least pop in to vn to suprise her and your children somewhere in the middle of her trip?

did you keep daily contact with your wife when she us in vn?
