then follow the number to whatsapp to ask some stuff but never make a booking then the person says i never read the terms and condition (once send a text = must make payment) and ask me pay the booking fee otherwise keep saying her company will bring case to court and become police case. and payment is via online bank transfer.

any bros know if such thing can happen?

I'm not a lawyer. But logically the trouble and cost of filing this and bringing this to claims is probably higher than the rewards.

Yeah, don't worry about it. If the terms and conditions are unfair and 1 sided, the Court will not allow the guy to enforce it. Just ignore them, if they continue to harass you, just report police for harassment. If it get worse, just go apply Personal Protection order(PPO) and threaten to put them in the public light.

Ur whatsapp is already an evidence proving there is no agreement. And no escort would ask customers to pay via online. Most practice i know of is to pay the escort in cash when meeting. Hope im right....

There is no term in their so called T&C about once send a text = make payment. The agreement to their T&C part is also a shitload of gamut to impress and nothing will hold water. By all means, if they want to go to court go ahead. Cost will be theirs to bear if the judge throw out their case.

- "once send a text = must make payment" - why got such thing send a sms mean pay already.. esp u hv not make any booking.
- "payment is via online bank transfer" - anything that require pay in advance esp via transfer of money already tell u is a scam

if they want take u to court, keep all the msg exchanged.. and told them u will oso make a police report. on ur side u hv done nothing wrong, u just make enquiries but is their side who threaten u to take u to court.. tell them let see who will win.

I agree with the rest, just ignore them. Those threats are probably empty. Their website advertises sex openly. That's prostitution, and I doubt they're licensed. Do you think they dare bring it to court?

Even if they're legit, 3 further reasons why u need not worry:

1) No police case: Their claim is for breach of contract. That is a civil matter. At the very most, they bring their claim to the small claims court. Police won't get involved.

2) They have no case: I don't even see the unusual term requiring u to pay upon sending a message under their terms and conditions. They are probably referring to their rules, which u might not have read. Take it from me that at law, unusual terms must be highlighted to the other party(i.e u).

3) Cheap legal fees: How much do they want from you? Whatever it might be, I'm guessing it's surely less than $10000, in which case u only go to the Small Claims Tribunal where lawyers are NOT ALLOWED. So basically, you'll represent yourself and so will they. No big legal fees involved.
