SINGAPORE: A 54-year-old baker was sentenced to a month in jail on Monday (Mar 21) for assaulting his colleague with a metal rod last November.
Chelladurai Nadarajan pleaded guilty to causing hurt on “grave and sudden provocation”, under Section 334 of the Penal Code, a section rarely invoked, Deputy Public Prosecutor Sivabalan Thanabal said.
WORK DISPUTE ESCALATED AFTER RACIST COMMENT
The incident took place at the Sweetleaf Bakery and Deli at Bedok at around 3am on Nov 29, 2015. Chelladurai assaulted Wang Git Han with a metal rod after the fellow baker taunted Chelladurai and challenged him to a fight after a work-related dispute. Chelladurai initially ignored Wang, but “lost control” after Wang made a racist comment against Chelladurai’s mother, who had died recently.
After Wang's comment, Chelladurai took a 70cm-long metal rod meant to remove baked goods from the oven and struck Wang repeatedly on the head and body.
The attack was halted when another colleague intervened.
DPP Sivabalan told the court the attack was “prolonged and sustained”, and continued even when Wang was in a "submissive position” lying on the floor. Wang ended up with a fractured kneecap, a cut on his forehead and bruising of the heart muscle.
“The length of the attack and the number of hits is testament to the viciousness of (Chelladurai) in meting out as much harm as he could inflict”, the DPP said. The bakery’s CCTV camera captured Chelladurai hitting Wang 24 times with the metal rod.
Defence lawyer Cheng Kim Kuan said if Chelladurai had been vicious, the victim “would not have walked away with a mere fracture”.
District Judge Kessler Soh said to Chelladurai: “The victim said certain things to you … which he shouldn’t have." He also noted that the baker had shown remorse and paid for Wang's medical expenses of S$2,300.
However he agreed with the prosecution that Chelladurai’s attack had been “excessive” and warranted a jail term.
“This must be very hard on you”, Judge Soh told Chelladurai. “If you encounter this in future, you must try to get away from it … exercise your control”, the judge told Chelladurai.
For voluntarily causing hurt on grave and sudden provocation, Chelladurai could have been jailed up to three months and/or fined up to S$2,500.
