BI issues deportation order vs. Pemberton

Metro Manila (CNN Philippines) — The Bureau of Immigration (BI) has ordered the deportation of U.S. Lance Cpl. Joseph Scott Pemberton, deeming him an undesirable alien.

In a resolution dated September 16, 2015, the BI said Pemberton posed a risk to public interest.

Pemberton is facing a murder case before a regional trial court (RTC) in Olongapo over the death of Filipino transgender woman Jennifer Laude.

The BI said the issuance of an arrest warrant against Pemberton for the murder case was enough evidence to warrant his deportation.

It also cited the testimony of Mark Gelviro, aka Barbie, before a Senate hearing saying that Pemberton was the person who most likely killed Laude as a basis for its decision.

Barbie was allegedly with Laude when she met Pemberton at a bar in Olongapo on the night of October 11 last year.

The BI said that a foreign national could be considered undesirable if he committed an act constituting a criminal offense punishable by imprisonment of one year or more.

In this case, the BI said the murder charge against Pemberton carries a penalty of more than one year.

The Olongapo RTC Branch 74 has yet to issue a decision on Pemberton's case.

His lawyer, Atty. Rowena Garcia Flores, said the BI's resolution was a pre-judgement as it was issued even before the court's ruling on the case.
