An honorable member of the Coffee Shop Has Just Posted the Following:

Not many people know about this sec 27 and 28 Defamation act 1974 where defendant can counter sue the plaintiff for false allegations on:

Sec 27 applies to any written complaint letter by any government dept, Council to the receiver.

Sec 28 applies to Police Report (a complaint letter) to the receiver.

1. Any person filed a written complaint letter to a government office or department (big or small office), Council or Police report and it was send to the receiver.

2.And if the defendant find the allegation(s) was NOT true - frivolous, vexatious, vendetta or vindictive he can sue the plaintiff for defamation if (3) qualifies.

3. If the government department or Police do not wish to take further action on the complaint letter, the receiver can sue the complainant for defamation under sec 27 & 28.

This is why you don't suka suka think you can make a complaint of your noisy neighbor to a government dept/ police thinking they can provide free legal service to you for your vindictive or vendetta agenda.

Was the Police report filed against Amos has had any vindictive, vendetta, frivolous vexatious reasons behind it?

The defendant can write to the plaintiffs to indicate a counter sue filed for defamation under sec 27 & 28 for false allegations if police decided to drop one or two of the complaint statements filed, if any.

A Police report is an initial complaint statement made by plaintiff only. The Police has to make investigation of the complaint(s) has any frivolous, vexatious, vendetta or vindictive motive before laid charges and go to court.

It has to qualify for charges laid until Police investigation is over and proceed to the court is judged.

If Police drop the charge, or some of the charges, the defendant can sue the plaintiff for defamation.
